The holiday season may be merry for businesses due to increased sales, but retail employees often face a far more grim reality.

For many workers, both at brick-and-mortar and online stores, it means longer and more grueling hours, increased stress, and frequent unpaid
“off-the-clock” work.

Many retailers now open their doors for Black Friday bargains before most of us have even finished our pumpkin pie. As such, retail workers spend Thanksgiving week – and often up to five weeks after the holiday season, when people exchange gifts and use gift cards – stocking and pricing high volumes of merchandise, training a new seasonal worker, and resetting stores for the next day.

Knowing that the corporate office is paying close attention to the bottom line on a daily basis during this period, management will frequently make holiday rush employees stay after they have clocked out to prepare for the next day, come in a little early and/or stay late to process stock and shipments, or take customer service calls to expedite orders when they aren’t meant to be working.

Federal law mandates that non-exempt employees must be paid for ALL time worked. Moreover, these “off-the-clock” hours should usually be paid at an overtime rate of one-and-a-half times the worker’s regular hourly rate.
